These Terms govern your use of Everbloom, an on-device daily botanical puzzle with optional one-time cosmetic purchases and optional per-season passes. By using the app, you agree to these Terms. If you do not agree, do not use the app.
Guy Levi grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Everbloom for personal entertainment, subject to these Terms and the app store rules that apply to your device.
You may not copy, modify, reverse engineer, sell, rent, sublicense, or distribute Everbloom except where law gives you a non-waivable right to do so.
Everbloom currently has no user accounts and no Everbloom server account system. Gameplay state, settings, herbarium entries, and cosmetic selections are stored locally on your device.
You are responsible for your device, backups, app store account, and any local data loss caused by clearing app data, changing devices, or deleting the app.
Optional cosmetics are non-consumable digital items that change presentation only. They do not create cash value, ownership of intellectual property, gameplay advantages, or a right to transfer, resell, redeem, or exchange items.
Season Passes are optional, non-consumable, one-time purchases. Each Season Pass is scoped to one named Everbloom season. Owning a Season Pass permanently unlocks that season's exclusive cosmetics and practice access to that season's past daily puzzles.
Archive practice is separate from today's shared daily. It does not change the daily deck, move legality, scoring, pruning, daily statistics, Herbarium daily record, or any competitive outcome. Season Passes do not provide score boosts, easier puzzles, extra prunes, or gameplay advantages.
Each future season is a separate purchase unless the store page says otherwise. A Season Pass for one season does not grant another season's pass, future season cosmetics, or future season archive practice.
One-time cosmetic items and Season Pass products are configured and billed through the app store where you purchase them. Store product pages show the current price and any applicable tax before purchase. Prices shown in Everbloom are provided by the store and may vary by region.
Payments are processor-hosted through Apple App Store billing or Google Play Billing. Everbloom does not store full card numbers, bank details, store credentials, or billing profiles.
Refunds, chargebacks, family sharing, purchase restoration, and billing disputes are handled through the applicable app store and its policies except where law requires otherwise. Guy Levi does not control Apple or Google refund decisions. Use the app store restore-purchases flow to restore recognized one-time cosmetics and Season Passes for the store account used to buy them.
You may not use Everbloom to:
Everbloom currently has no user-generated-content hosting. If a future feature allows user content, you will be responsible for your content, and Guy Levi may remove content or terminate access for violations.
Guy Levi may suspend, terminate, or refuse access to Everbloom or related services if you violate these Terms, create legal risk, misuse purchases, or where required by law or app store rules.
You may stop using Everbloom at any time by deleting the app.
You are responsible for your conduct, device, local app data, and any content or information you choose to share from the app.
To the maximum extent allowed by law, you agree to indemnify and hold harmless Guy Levi from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of Everbloom, violation of these Terms, violation of law, or infringement of third-party rights.
Everbloom is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, error-free operation, or preservation of local data.
Daily puzzles, purchases, restoration, sharing, and platform services may be unavailable, delayed, or changed because of device, operating-system, app-store, or network conditions outside Guy Levi's control.
To the maximum extent allowed by law, Guy Levi will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, device issues, or purchase-platform interruptions.
To the maximum extent allowed by law, Guy Levi's total liability for all claims related to Everbloom is capped at the greater of the amount you paid for Everbloom cosmetics and Season Passes in the 12 months before the claim or USD 100.
Some jurisdictions do not allow certain limitations, so some limits may not apply to you.
Your use of Everbloom is also subject to Apple App Store or Google Play terms, depending on where you obtained the app. If these Terms conflict with mandatory app store terms, the app store terms control only to the extent of the conflict.
Guy Levi may update these Terms before a release. Continued use after an update means you accept the updated Terms.
These Terms are governed by the laws of the State of Florida, USA, excluding conflict-of-law rules, except where consumer protection law gives you non-waivable rights in another jurisdiction.
